Two Neiman Marcus employees argue offsite: black man fired and white man eventually promoted

A racial discrimination lawsuit filed by an ex-employee against Neiman Marcus is now in arbitration.

When Gerry Fisher thought his car was hit in a nearby parking garage, he got out to examine the damage. He claims Scott Sorbet, began cursing at him and used a racial slur. Fisher, a former accountant at the luxury retailer, did not know Sorbet was a manager at Neiman.

Sorbet reported the incident to human resources and Fisher was questioned and reminded of the retailer’s zero tolerance for violent behavior. According to court documents, his comments were perceived as threatening and he was fired. Sorbet eventually received a job promotion.

Regarding the claims he used a racial slur, Sorbet denied it on the grounds Harriet Tubman was his hero after he completed a research paper on her in grade school.
