JCPenny scales back Martha Stewart merchandise before ruling in Macy’s case

jcp_Flag_4c_APerhaps seeing the writing on the wall, Plano-based JCPenny has thrown in the towel in their battle against Macy’s on the right to carry Martha Stewart products.

The Dallas Business Journal is reporting:

“With a ruling apparently near in the long-running lawsuit between Macy’s and J.C. Penney Co. Inc. over the right to sell Martha Stewart-branded products, Plano-based Penney and Martha Stewart Living Omnimedia have cut back the merchandising agreement that caused all the problems.

Penney has agreed that it will not sell kitchen, bed and bath products designed by Stewart that were sold under the “JCP Everyday” label, the New York Times reported.

J.C. Penney will, however, continue to sell other Martha Stewart wares, including window treatments, rugs and lighting under the “Martha Home” label.”
